Consumer Privacy Rights

Your Rights and Choices

If you are a resident of certain states, you may have the following rights under applicable consumer privacy rights laws:

Access Rights

You have the right to request that Mitchell Stores disclose certain information to you about our collection and use of your personal information. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and,
    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

You can also request to receive the personal information that you have provided to us in a structured, commonly used, and machine-readable format. You also have the right to request that we transmit this data directly to another data controller, if technically feasible. This includes data you have actively provided, such as your email address and other contact information, as well as data generated by your activities, such as purchase history and/or online search history. The right does not apply to data that is inferred or derived from the data you have provided.

Deletion Rights

You have the right to request that Mitchell Stores delete any of your personal information that Mitchell Stores collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to, for example:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, protect the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with a legal obligation or applicable law(s).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Some of these exceptions may or may not apply under certain state laws, and this list of exceptions is not exhaustive under all applicable state laws.

Correction Rights

You have the right to request that Mitchell Stores correct inaccurate personal information about you. We will take into account the nature of the personal information and the purposes of the processing of the personal information in responding to your request. We will process your request if we receive a verifiable request and we will use commercially reasonable efforts to correct the inaccurate personal information as directed pursuant to applicable law.

Your Right to Limit the Use of Sensitive Personal Information

You have the right, at any time, to direct us to limit our use of your sensitive personal information only to that use which is necessary to perform the services or provide the goods reasonably expected or to fulfil the reason that we collected such information and/or other permissible business purposes.

Sensitive personal information includes information only to that use which is necessary to perform the services or provide the goods reasonably expected or to fulfil the reason that we collected such information and/or other permissible business purposes. Sensitive personal information includes:

  1. Financial Information — your financial account log‐in credentials, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account.
  2. Geolocation — your precise geolocation.
  3. Communications — the contents of your private communications, unless we are the intended recipient of the communication.

Please note that we do not use or disclose your sensitive personal information for purposes other than to provide you with products and/or services. However, note that this information may be used, or disclosed to a service provider or contractor pursuant to a written agreement in order to provide such products and/or services. If you choose to limit such use, you can opt in to such use again by contacting us via email. Note that this right does not apply to sensitive personal information that is collected or processed without the purpose of inferring characteristics about you.

Exercising Your Rights

If you are a resident of a state with an applicable privacy law and you want to exercise any of your rights as set forth above, please submit the relevant form via mail, call us at 1-844-855-4847, or email us at privacy@mitchellstores.com. For all email requests, it is helpful to put the statement "Consumer Privacy Rights" in the body of your request, describe the nature of your request, and provide your name, street address, city, state, and zip code. In your request, you need to attest to the fact that you are a resident of a particular state so that we may determine if such state has an applicable privacy law and provide a current address in that state for our response.

Only you, or a person registered with the applicable Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. For all requests, it is helpful to put the statement "Consumer Privacy Rights" in the body of your request, describe the nature of your request, and provide your name, street address, city, state, and zip code. In your request, you need to provide enough information that allows us to reasonably verify that you are the person that we collected information about.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Right to an Appeal

Pursuant to applicable law(s), if you disagree with a decision that we have made related to your privacy rights, you may have the right to request an appeal of that decision. Please email privacy@mitchellstores.com with the subject line of "Appeal Request" and a detailed explanation as to why you are appealing our decision. Once received, a representative will review the request and respond to you within 30 calendar days.

If we deny your appeal, you may submit a complaint to your respective state Attorney General. We will include details related to this right in our denial response to your request.

Response Timing and Format

We will confirm receipt of a verifiable consumer request within ten (10) days and provide information about how we will process the request.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 45 days), we will inform you of the reason and extension period in writing.

We will deliver our written response by mail or electronically, at your option.

We will respond to your opt-out request within 15 days of receipt.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically CSV format.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

For all requests, it is helpful to put the statement “Consumer Privacy Rights” in the body of your request, describe the nature of your request, and provide your name, street address, city, state, and zip code. In your request, you need to provide enough information that allows us to reasonably verify that you are the person that we collected information about.

Do Not Sell or Share My Personal Information

We may use your personal information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

  1. We use Google Analytics to help us understand how our customers use our Site. You can read more about how Google uses your Personal Information here. You can also opt out of Google Analytics here.
  2. We share information about your use of our Site, your purchases, and your interaction with our ads on other websites with our advertising partners. We collect and share some of this information directly with our advertising partners, and in some cases through the use of cookies or other similar technologies.

We share personal information with third party vendors to provide more relevant, personalized ads to consumers. We also use third party data analytics providers whose collection of information may be considered a "sale" of information under applicable law. A consumer or their representative may instead submit a request to opt out of sharing or selling by sending an email to privacy@mitchellstores.com.

Please note that online opt-outs are device and browser-specific. You may still see personalized ads from us while using a different device or browser, unless you also opt out using that device or browser.

Please note that some third party vendors do not respect the U.S. Privacy String, which is the mechanism we use to communicate your Request to Opt-Out to third parties that collect information via cookies on our Site. If you choose, you may also use the Digital Advertising Alliance (DAA) WebChoices Tool to globally opt out of third-party tracking via website cookies.

Additionally, we do not intend to market to any individual under the age of 18, and we expressly prohibit, anyone under the age of 13 from disclosing or submitting any personal information to us through our Site or other means. Therefore, we do not sell and/or share for cross-context behavioral/targeted advertising or use any information of any individual under the age of 18.

Global "Do Not Track" Signals

Some web browsers allow you to set a global "Do Not Track" flag that is visible to websites. We do not take any action in response to this signal. We will comply with applicable opt-out preference signals as described in the section below.

Non-Discrimination/No Retaliation

We will not discriminate or retaliate against you for exercising any of your privacy rights. Unless permitted by law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Opt-Out Signals

We will comply with opt-out preference signals (OOPS) that inform us that you don’t want your personal information to be sold or used for targeted advertising, if the signal is sent from a platform or mechanism, such as Global Privacy Control, that enables us to accurately determine whether you are a resident of a state with an applicable law regarding OOPS. If your OOPS conflicts with your previously given privacy choice, we will still comply with the opt out preference signal. We may notify you of the conflicting signals and ask you to confirm your choice with the understanding that it will affect your previously given privacy choice.

However, note that these signals are associated with a specific device or browser and will not transfer when you switch web browsers or devices, such as from a laptop to a mobile device. Additionally, we do not keep records that match users to their web browsers or IP addresses. Therefore, you will need to submit a written request to exercise these rights as they relate to your information in our customer records.
